The humiliation of being arrested in your own home and being walked out of your own front door and locked in a police van is bad enough. People just don't understand false accusations. Many people believe if you've been arrested you must be guilty of something right?
Maybe your employer gets to hear of your arrest and decides that it's best if you don't come back to work until it's all been sorted
If you live with the person who has made a false accusation against you then, should you be granted bail it's likely there will be a condition that you won't be allowed back to that house until this nightmare comes to a conclusion.
You'll be ejected from the custody suite with just the clothes on your back and will be calling a friend to see if you can sleep on his sofa for the next few nights until you can sort something out that's more long term
Alot of the time this was the motivation for the false accuser in the first place. Ensuring that you have limited access to your kids. Chances are you won't be allowed to contact your false accuser under any bail conditions you are subject to and whom of course is likely to be the mother of your children and is allowed to remain in your home... a place you're now not allowed to go to.
Want to pursue access to your children in the family court? On many occassions the family court will just defer any order until your criminal trial has concluded. Plus anything you do submit as evidence to the family court will be handed over to the CPS to see if they can use any of that against you. Also because family court hearing are held in private, if you do decide to use any evidence in the family court that evidence that you may rely upon in any criminal trial now can't be disclosed
If the accusations are really serious and you're unable to convince a magistrate that you should be granted bail expect to be locked away for several months whilst you await your trial. If your trial is in the magistrates courts this could be up to 56 days but if your trial is in the crown court it's currently 182 days. That's right even if you've done nothing wrong you can be imprisoned for up to 6 months.
Definitely the hardest aspect to accept as it's the one resource that no one person on this planet can buy.
You may have been lucky and released under investigation (RUI) but you'll likely be waiting months and in some cases years for the police to get back to you telling you at best there's going to be no further action (NFA) and if worst that they've decided to charge you.
If you've been released on bail you might think as it says on this piece of paper "return to the police station in three months" they'll have made a considered decision and this will all go away. The reality is that many people's bail gets extended. The police can extend bail up to 9 months before having to get an extension in the magistrates court.
Forget innocent until proven guilty or any of the prosecution to see any sense whatsoever. If you're "lucky enough" to be on bail expect restrictions such as where you must reside each night. That you can't leave the country for a holiday and even be subjected to wear an electronic ankle tag.
Most people think evidence means CCTV or text messages or hospital reports with pictures of broken bones or bruises. Not in cases of domestic abuse. The accusers statement to the police is enough for the CPS to charge you.
Don't expect any evidence you submit in your defence to bring things to a logical end. Your false accuser could be holding a smoking gun and it'll still go to trial. Domestic Abuse is the fashionable crime to be seen to be punishing.
The people who know and love you will support you but be prepared for people you don't know so well or have just recently met you to unfairly judge you simply because you're being made to go through it. Expect women to run a mile
You maybe lucky and qualify for legal aid. However if you don't then you're in for a shock. This is likely to get very expensive very quickly. When you are found not guilty you will only be awarded a fraction of the costs that you have paid to defend yourself
Don't expect anything to come back on your false accuser. They'll likely walk away without any consequences of their actions whilst you're forced to pick the piece up of whats left of your life.
